# Terms of Service

Welcome to Taletreck. These Terms of Service (“Terms”) govern your use of the Taletreck website and service operated by Taletreck (“we,” “us,” “our”). By using our service, you agree to these Terms.
If you do not agree, do not use the service.

## 1. The Service
Taletreck transforms outdoor adventure photos uploaded by users into narrated cinematic video stories using artificial intelligence. We process photos, generate written narration, produce voice narration, animate photos into video clips, and deliver a final assembled video by email.
## 2. Eligibility
You must be at least 18 years old to use Taletreck. By using the service, you confirm you meet this requirement.
## 3. Your Content
### 3.1 What You Upload
You may upload up to 20 photos per project, along with optional notes about your trip.
### 3.2 Ownership
You retain full ownership of all photos you upload.
### 3.3 License You Grant Us
By uploading photos, you grant Taletreck a limited, non-exclusive license to:
– Process and modify your photos through AI services to generate the requested video
– Store your photos and generated outputs on cloud infrastructure (Amazon Web Services)
– Transmit your photos to third-party AI processors solely for the purpose of producing your video
This license ends when your project files are deleted from our systems.
### 3.4 Your Responsibilities
You confirm that:
– You own or have the right to use every photo you upload
– Your photos do not infringe on anyone’s copyright, trademark, or other rights
– Your photos do not contain illegal content, hate content, sexual content involving minors, or other prohibited material
– Any people identifiable in your photos have consented to your use of their image
You are solely responsible for the content you upload.
## 4. Generated Videos
### 4.1 Ownership
The final video produced by Taletreck is yours to use for personal purposes — share with family, post on social media, keep as a memory.
### 4.2 Commercial Use
Generated videos are for personal use only. Commercial use (resale, paid client work, advertising, broadcast) requires separate written permission from Taletreck.
### 4.3 No Guarantees on Output
AI-generated content can be unpredictable. We do not guarantee:
– Specific narration text or wording
– Specific visual animations
– That every photo will animate as you imagine
– That captions will perfectly describe each photo
You receive one free revision per project to address quality issues.
## 5. Payment and Refunds
### 5.1 Pricing
The current price is $24.99 USD per project. Pricing is shown at checkout and may change for future orders.
### 5.2 Payment Processing
Payments are processed by Stripe. We do not store your full credit card information.
### 5.3 Refund Policy
Due to the cost of AI processing performed immediately upon order, we do not offer refunds once production has started. If your video is not delivered or has a technical defect, contact us at info@taletreck.com and we will either fix the issue or issue a full refund at our discretion.
### 5.4 Free Revision
Each order includes one free revision. Use this to request changes to narration tone, photo order, or to replace photos that did not animate well.
## 6. Service Availability
We aim to deliver each video within approximately 30 minutes of order completion. We do not guarantee specific delivery times. Service interruptions may occur due to third-party API outages, maintenance, or technical issues. We are not liable for delivery delays beyond our reasonable control.
## 7. Prohibited Use
You may not use Taletreck to:
– Process photos you do not have rights to
– Create content depicting violence, hate, or illegal acts
– Reverse engineer, copy, or compete with our service
– Attempt to interfere with or disrupt the service
– Use the service in any unlawful manner
We reserve the right to refuse service, cancel orders, and terminate accounts that violate these Terms.
## 8. Third-Party Services
Taletreck uses third-party AI providers including but not limited to OpenAI, Runway ML, ElevenLabs, Amazon Web Services, Stripe, and Resend. By using our service, you acknowledge that your photos and notes will be processed by these third parties under their respective privacy and security practices. We choose providers committed to data protection but cannot guarantee their performance or security beyond our agreements with them.
## 9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the service will be uninterrupted, error-free, or that defects will be corrected.
## 10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALETRECK’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of use.
## 11. Indemnification
You agree to indemnify and hold Taletreck harmless from any claims, damages, losses, or expenses (including legal fees) arising from:
– Your use of the service
– Photos or content you upload
– Your violation of these Terms
– Your violation of any third-party rights
## 12. Termination
We may suspend or terminate your access to the service at any time, with or without notice, if you violate these Terms or if we discontinue the service.
## 13. Changes to These Terms
We may update these Terms from time to time. The latest version will always be posted at this URL with the “Last updated” date. Continued use of the service after changes constitutes acceptance.
## 14. Governing Law
These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles. Any disputes will be resolved in the courts of Quebec.
